TERMS AND CONDITIONS OF THE APP CALLED "BEAGLEPLUG" These general terms and conditions of contract (hereinafter also referred to as the "General Conditions" or "Contract") govern the terms and conditions of the services as described below (hereinafter the "Services" or, individually, the "Service") provided by ElectriEase srl (hereinafter referred to as "ElectriEase" or "EE") through the APP called "BEAGLEPLUG" (hereinafter referred to as the "App") to customers who have decided to use the App in the manner indicated below (hereinafter, the "Customers" or, individually, the "Customer").
To use the Services, the Customer must access the App:
- registering, after filling in the required fields, or
- without registration (see art. 2.6)
In both cases, the use of the App implies the customer's acceptance of these General Terms and Conditions, as well as the Privacy policy and Cookie policy as illustrated in this document and/or available in the appropriate dedicated sections of the App or via hyperlink.
Article 1 – Object of the contract
These General Terms and Conditions govern the terms and conditions of the Services described below, which are provided by ElectriEase, directly or through third parties appointed by it, through the use of the BeaglePlug App:
- charging of the electric vehicle at charging points accessible to the public through the App or through the associated RFID card (hereinafter, the "Public Charging Stations") compatible with the Service;
- map display of the Public Charging Stations dedicated to electric vehicles compatible with the Service;
- management via the App or through the RFID card of the start of charging and the interruption of charging at charging points for domestic use and/or at boxes/garages separate from the main residence (hereinafter, the "Home Charging Stations") or for business use (hereinafter, the "Company Charging Stations") whose access through the App is reserved only for authorized Customers. Home Charging Stations and Business Charging Stations are collectively referred to as Private Charging Stations;
- setting up favorite Public Charging Stations;
- reservation of the socket of the Public Charging Stations for a predefined period of time prior to the unlocking and start of the charging process on the selected charging station, in the event that the socket reservation service is operational;
- display of the route to reach the selected Public Charging Station, with the support of the most popular navigation apps;
- unlocking of the individual socket and start of the charging process on the selected Public Charging Station, also via RFID card associated with the account created by the Customer following registration on the App (hereinafter, "Account");
- monitoring of the charging process, for stations enabled to provide this information;
- interruption of the top-up process by clicking on the dedicated button on the App or by using the RFID card associated with the Account;
- request for a free RFID card after the first recharge of the "wallet" (see art 8)
- automatic payment of the fee for the charging service at Public Charging Stations, according to the methods set in the Account (credit card, wallet);
- display, in a dedicated section, of the history of charging sessions;
- change in the payment method associated with the Account;
- subscription to one or more tariff plans associated with the same Account. Some tariff plans may be characterised by a dedicated display of the charging stations that the Customer can access. The identification of special tariff plans (meaning the tariff plans that can be activated by entering a specific code) is done by entering a unique code in the dedicated section of the App;
- Acceptance and modification of their tariff plan.
- Managing your own electric vehicles
- Management of your own private charging stations
These Terms and Conditions apply to the Services provided by EE in the territory in which they are available, as indicated on the App.
Article 2 – Access to the App with and without registration and related obligations of the Customer
2.1 The use of the App is permitted only to natural persons who, at the time of registration and/or use without prior registration, are authorised to drive or rent any electric vehicle, and to legal persons.
2.2 To use the Services, the Customer can register on the App in advance, free of charge, by filling in the required fields. By completing the registration procedure and clicking on the "I accept" button, the Customer declares that he has carefully read and expressly accepted these General Conditions.
2.3 In order to use the Services, if the Customer has registered, the Customer must perform the following additional operation on the App:
enter at least one payment method (credit card, wallet).
The activation of the Service is in any case subject to the positive outcome of the verification by EE of the correctness of the data relating to the payment method entered when subscribing to the Service itself.
2.4 The Client guarantees that the data entered during registration on the App are correct, up-to-date and truthful. The Client also undertakes to promptly communicate any change in the data useful for the correct issuance of the sales documents relating to the purchase of the Services. In the event of incorrect data, the Customer is required to promptly notify EE via the contact details provided within the App or by writing to [email protected]
2.5 The Customer acknowledges and accepts that, if he/she has communicated false, outdated or incomplete data to EE, EE reserves the right to suspend access to the App and/or terminate the Contract pursuant to Article 1456 of the Civil Code, withholding the sums paid by the Customer and reserving the right to claim compensation for any greater damages.
2.6 Customers who wish to use the App without registering may only use the services indicated below, upon entering the data necessary for payment:
- charging of the electric vehicle at the Public Charging Stations compatible with the Service, which the Customer can access through the App;
- map display of the Public Charging Stations dedicated to electric vehicles compatible with the Service;
- display of the route to reach the selected Public Charging Station, also through the use of the most popular navigation apps;
- unlocking the individual socket and starting the charging process on the selected Public Charging Station;
- monitoring of the charging process for stations enabled to provide this information;
- interruption of the charging process using the appropriate button that can be viewed on the App;
- automatic payment of the fee for the Service, with the pay-as-you-go tariff.
2.7 The Customer is obliged to vacate the charging station at the end of the vehicle charging session. In the event of use of certain Public Charging Stations expressly indicated on the App, a sum will be charged for failure to remove the charging connector from the socket, within the terms and in the manner provided for by art. 4.2.
Article 3 – Duration and withdrawal
3.1. This Agreement is for an indefinite period.
3.2. The Client may in any case exercise the right to change his mind within 14 days of adhering to this Contract. If the Customer requests the performance of the Services provided for in the Contract during the expiry of the terms of the change of mind and subsequently exercises the right to change his mind, the costs relating to the use of the Services used until deactivation may be charged. The Customer may exercise the change of mind by sending a communication to the [email protected] email or by clicking on the appropriate section of the App. The Customer will receive feedback on the management of the change of mind by email. 3.3. The Client may withdraw from this contract at any time by sending a request for deactivation of his Account, by written notice to the [email protected] email or by clicking on the appropriate section of the App. EE will deactivate the Account within 2 working days of receiving the email or by clicking on the appropriate section of the App. In this case, the Customer will be invoiced for the fees relating to the Services used until the deactivation of the Service.
3.4. Termination by the Client will result in the deactivation of the Account, and the automatic termination of the effectiveness of the Contract and of any consequential relationship connected to the Service.
Article 4 – Economic conditions
4.1. In order to use the Services through Public Charging Stations, the Customer is required to pay the fees relating to the aforementioned Station, as described in the detail sheet of the individual Public Charging Station concerned. These fees are indicated with VAT included and are all-inclusive, without prejudice to the provisions of art. 4.2.
4.2 In the case of use of certain Public Charging Stations expressly indicated on the App, the Customer will be charged a sum for failure to remove the connector from the charging station socket within a certain number of minutes following the end of the vehicle's charging session. The number of minutes beyond which the amount for non-removal will be charged and its cost may vary from station to station and are expressly indicated in the "Station Info" section of the station itself. This amount will be charged to the Customer for each minute following the limit after the end of the charging session, and until the connector is removed from the socket used. The amount of this sum is shown in the detail sheet of the individual Public Charging Station concerned, it is to be understood as including VAT.
In the event that the charging session was started with a subscription rate plan, the final amount of the parking fee will be charged to the default payment method associated with the subscription rate plan. In addition, if at the end of a recharge the kWh used exceeds that available in your subscription plan balance, an amount calculated on the basis of the excess kWh and based on the PayXUse tariff of the charging station used will be deducted. 4.3. The Tariff Plans can be pay-as-you-go or fee-based and can be viewed within the App. The parameters for quantifying the cost of the service for pay-as-you-go services are:
- € per minute;
- € per kWh;
- € when starting the top-up
4.4 The Customer who subscribes to a fee-based tariff plan can choose his own tariff plan and modify/cancel it at any time at no additional cost, according to the variation methods described below:
- For each top-up initiated by the APP, the user can decide whether to use the pay-as-you-go or subscription payment plan;
- In the event of a change from a "fee-based" tariff plan to another "fee-based" tariff plan, the new plan will apply from the month following the request, on the day following the day on which the previous plan was subscribed (e.g. if the fee-based tariff plan was subscribed on 1 January, and on 10 January the change of the plan is requested, The new plan will apply from 2 February). If a user chooses a tariff plan that includes the "early renewal" service, the new plan will be active immediately.
- In the event of use of the early renewal service, it will be possible to purchase a "fee" tariff plan of an amount equal to or greater than the one in use
- In the event of subscribing to a "fee" tariff plan containing the "kWh conservation" service, the kWh not used during the subscription period will also be made available in the following period. In the event of cancellation of the automatic renewal of a "fee" tariff plan containing the "kWh conservation" service, if the kWh have not been used by the end of the validity period of the current plan, the unused kWh will still be available for a "grace period" of 30 days beyond the expiry date. In the event that a new subscription is taken out within the "grace period", the available kWh will be added to those purchased with the new "fee" tariff plan.
- The renewal of the subscription takes place only when the renewal bank transaction is successful. If for reasons not attributable to EE the renewal is not successful, it will automatically be considered as cancelled, it will therefore be necessary to carry out a new subscription procedure
Article 5 – Booking service
The reservation service may only be used for charging infrastructures for which this service is available. The Customer can view the availability of the booking service by selecting the charging station on the App map and clicking on the "Book" button. Some Public Charging Stations indicated on the App may be subject to partial limitation of the power available at certain times of the day. The rates applied to the charging sessions provided by these infrastructures do not change, however the cost of the reservation will be explained in the appropriate section of the app.
Article 6 – Invoicing relating to charging through Public Charging Stations The invoice shows the debits and/or any credits, specifying the related services used. The invoice is issued on the occasion of each transaction and sent to the e-mail address indicated during registration.
The billing frequency varies depending on the selected pricing plan as follows:
- "Pay-as-you-go" tariff plan: the invoice is issued and sent to the customer within 48 hours of the end of each charging session via the Public Charging Station;
- "Fee" pricing plan: the invoice is issued and sent to the customer 48 hours after the day of subscription to the plan or renewal.
Article 7 – Payments
7.1 The payment service used by BeaglePlug is managed by Stripe Payments Europe Ltd, a company that provides the In-app payment platform, which allows the customer to make payments in absolute security. You can use VISA, MASTERCARD, American Express credit cards, as well as the so-called "wallet" and RFID card (see Art. 8).
7.2 Payment for the Service will be made through the payment method that the Customer chooses at the time of top-up. If more than one payment method is associated with the Customer's profile, payment for the Service will be made through the one indicated by the Customer as the "default", at the time of subscription to the Service or subsequently, even before the start of the single top-up. In the event that payment for the Service is unsuccessful, EE will notify the Customer and initiate a series of attempts to charge the amount due.
If the above attempts to charge are unsuccessful, EE will suspend the ability to use the payment method used by the Customer and will notify the Customer. In such a case, the Customer must indicate a valid payment method that allows EE to recover the amount due.
7.3 Otherwise, EE will make a new attempt to debit the fee owed by the Customer and, if this is not successful, EE may block the Account. In such a case, the Customer must indicate a valid payment method that allows EE to recover the amount due. Your Account will be automatically unblocked within 7 (seven) days of correctly entering your valid payment method. In any case, even before this deadline has expired, the Customer may request the unblocking by contacting EE at the [email protected] email .
7.4 In the event that the suspension lasts for more than 30 days, EE may terminate the contract pursuant to Article 1454 of the Italian Civil Code, subject to notice to comply within a minimum period of 15 days.
For security reasons, only the last four digits of the card and the type of circuit to which it belongs will be visible.
Credit card information is always encrypted when it is transferred over networks.
Article 8 – BeaglePlug Wallet and BeagleCard RFID Card
8.1 The BeaglePlug wallet is a sort of "electronic wallet or piggy bank" that can only be used to recharge at stations belonging to the BeaglePlug network. Once the wallet is topped up using a credit card, you have an electronic wallet from which to withdraw the credit to make a top-up. The purchase of the wallet therefore corresponds to having a voucher with credit equivalent to the money used forits ceiling
8.2 The Customer, using the appropriate section in the App, has the right to request an RFID card which uses electromagnetic fields to transfer data wirelessly (therefore without cables), in order to automatically identify and track tags connected to objects (meaning that with the use of RFID technology I have the possibility to identify the user who is starting the charging process)
8.3 The RFID card can only be requested after the first recharge of the "wallet" or following the activation of a "fee" subscription.
When the Customer receives the card, he must activate it in the appropriate section of the App.
In the same section, the customer can disable or block the card in case of loss.
In the case of an active "fee" subscription, by default the RFID card is associated with the fee-based tariff plan. However, the Customer can change the association manually from the appropriate section of the app, and associate it again with the Wallet for the pay-as-you-go plan.
The RFID card allows the Customer to charge the vehicle through Private Charging Stations and/or Public Charging Stations, in accordance with the user's profile.
8.4 The same RFID card may also be used for the Private Charging stations associated with the Customer's Account. In this case, the Customer can request the card even without having topped up the "wallet" or enabled a "fee" plan.
8.5 The conditions for requesting the RFID card are indicated in the appropriate section of the App.
8.6 The card will be sent to the shipping address indicated during registration.
8.7 The cost of the top-up will be charged directly to the corresponding wallet account. It will be possible to use the wallet credit to make a transaction either via RFID card or via App.
8.8 After 12 months of inactivity of the account, the account will be deactivated and the data will be anonymised, therefore the remaining credit will no longer be available to the customer and it will no longer be possible, by recharging the previous credit. In these cases it will be possible to obtain a refund of the unused credit by sending the relevant request to the [email protected] email; the refund will be calculated by debiting the residual value of the wallet with a deduction as a refund of the management service fees incurred by BeaglePlug.
8.9 In order to be able to start a top-up by selecting the Wallet as a payment method, it is necessary to have a minimum credit of more than 2 (two) € euros
8.10 The credit on the Wallet can only be used for the payment of top-ups with PayXUse pricing and cannot in any way be used for the subscription / payment of a subscription
8.11 It is possible to request a refund of the residual credit on the Wallet subject to deduction as reimbursement of the costs for the management service incurred by BeaglePlug equal to €3
Article 9 – Guarantee for the success of the credit
To guarantee the success of the credit, BeaglePlug applies a pre-authorization when the payment method chosen by the customer is "Credit Card".
The amount of the pre-authorization varies depending on the station and is explicitly indicated in the App before starting the recharge.
The amount of the pre-authorization is returned within 24 hours, however this timing may also depend on the credit institution issuing the credit card in use by the customer.
In the case of using the wallet, if the amount in the wallet at the end of the top-up is less than zero (0) €, BeaglePlug will make a request for authorization to the payment card linked to the user's account to cover the amount necessary to cover the debt. In this case, an additional VAT exempt tax may be applied pursuant to Article 10 of Presidential Decree 633/72 and subsequent amendments equal to the Financial Charges incurred by BeaglePlug.
In the event that the Customer has subscribed to a subscription, if at the end of the recharge the kWh remaining on the current subscription are less than zero (0), BeaglePlug makes a request for authorization to the payment card linked to the subscription for an amount equal to the number of kWh debited and multiplied by the PayXUse tariff of the charging station used in the last transaction made.
Article 10 – Home charging stations
10.1 The Customer can request the association of their Account with one or more Home Charging Stations by writing to [email protected] or do it independently through the appropriate section of the app if the charging station is equipped with a special QRCode
10.2 Once the Home Charging Station(s) have been paired, the Customer may start and stop charging in the manner indicated on the App.
10.3 It should be noted that for recharges carried out through Home Charging Stations, the cost of electricity for recharging depends on the tariff plan applied to the electricity supply of the meter to which the Station is connected. The cost of electricity from charging will be charged to the Customer by their electricity supplier in their bill. It is understood that EE is not a party to the contract between the Customer and its supplier for the supply of electricity that powers all Home Charging Stations.
10.4 Please note that, in order to be associated with your BeaglePlug app account, this station must be provided by EE. If there is already a charging station, in order to be connected to the customer's BeaglePlug account, it must comply with certain technical characteristics and be tested by the technicians of the BeaglePlug team. Therefore, this functionality is not guaranteed for charging stations not supplied by EE
Article 11 – Coupons and Vouchers
11.1 The Customer can take advantage of coupons that allow them to take advantage of discounts or promotions. The coupons allow you to use the charging services accessible through the App, for an amount expressed in €, limited to a certain group of Charging Stations expressly indicated in the Coupon itself. They can be activated via the App by entering the relevant identification code after starting the top-up.
11.2 The identification code of each coupon, as well as all the details relating to the use of the coupon, will be sent to the Customer at the e-mail address indicated during registration or by other means provided by EE and/or any third party partners who provide the coupon.
11.3 The Voucher allows the Customer to top up their Wallet by an amount equal to that indicated in the Voucher itself. It can be placed on the Wallet top-up screen.
Each Voucher and Coupon has an expiration date and can only be used once.
Article 12 – Disclaimer
12.1. EE is not liable for direct or indirect damages of any nature caused to the Customer or third parties not directly attributable to EE, such as damages due to changes in the methods, times and/or conditions of provision of the Service due to malfunctions of vehicles, technological equipment, computer and telecommunications systems and in any case dependent on causes attributable to the energy supplier and/or third parties in general.
12.2. In addition, any liability of EE for the total or partial non-fulfilment of the obligations assumed due to force majeure is excluded, such as, but not limited to: acts of the State and Public Administration, acts of the Public Authorities, legal limitations, fires, floods, explosions, mobilizations, riots, strikes, industrial disturbances, lack of raw materials, lack of electricity, interruption of telephone lines and others.
Article 13 – Prohibition of resale or commercial use of the Services
The Customer's right to use the Services subscribed to is personal and non-transferable. You are prohibited from reselling or making any other commercial use of the Services without the written consent of EE.
Article 14 – Intellectual property rights of EE and third parties
The Client expressly acknowledges that all intellectual property rights, which can be protected on the basis of copyright and copyright laws or other provisions such as the Industrial Property Code, including, but not limited to, know-how, source code, software, hardware, projects, applications, patents, trade secrets, formulas, algorithms, models, databases and the like, relating to the Services, data and other materials originating from EE or otherwise made available to the Customer by EE already under the General Conditions are and remain the property of EE and of the subjects of which it is the legitimate licensee. It is understood that the Customer may not copy, modify, sell, assign, license, confer, transfer to any third party or create derivative works from any right of EE and/or its legitimate licensee, nor allow any third party to do so through the Customer or its electronic device. Finally, the Client acknowledges that all the contents (software, images, graphics, photographs, music, sound, video, texts, data, etc.) of the promotional correspondence presented to the Client through the WEB MAIL service or by the WEB MAIL providers, are protected by the regulations in force regarding copyrights, trademarks, service marks, patents or other proprietary rights and laws.
Article 15 – Amendments and assignment
15.1 EE has the right to make changes, at any time, to these Terms and Conditions and the Services, including the economic conditions and the Fare Plans, for objective technical, organizational and/or commercial reasons, provided that such changes do not affect the performance of the main obligations assumed.
15.2 The above changes are communicated by EE to the Customers with an appropriate period of notice, not less than 30 days before their entry into force, by e-mail to the address indicated by the Customers at the time of registration and by accessing the App for those who do not intend to register. In the event that the Client does not intend to accept the changes, the Client shall have the right to withdraw from the Contract in accordance with the procedures indicated in Article 3 "Duration and Withdrawal".
15.3 It is understood that the use of even one Service by the Client will constitute a confirmation of its willingness to adhere to the General Conditions, to any particular conditions of the Service itself (provided for by specific Profiles) and to the related subsequent amendments. The Customer undertakes to maintain on an adequate and durable medium and to keep the General Terms and Conditions and all subsequent amendments thereto that may be made to them from time to time, without prejudice to the Customer's right to request a copy of the General Terms and Conditions from EE.
15.4 EE reserves the right to transfer or assign this Agreement, or any or all of its rights and/or obligations under this Agreement, to a third party upon notice to us in the same manner as set out in clause 14.2 above. You may not assign or transfer the Agreement, or any of your rights and/or obligations under the Agreement, to any third party without the prior written consent of EE.
Article 16 – Protection of personal data
The Customer's personal data will be processed exclusively in accordance with the current legislation on the Processing of personal data.
The processing of personal data for direct marketing purposes takes place through the traditional methods, or through the platform and IT tools offered by the company MailerLite Limited, with registered office in Ground Floor, 71 Lower Baggot Street, Dublin 2, D02 P593, Ireland, therefore, in the case of authorization to process data for marketing purposes, the user's email address may be known by this service provider. MailerLite guarantees the respect of the personal data subject to processing and operates, for this service, as a data processor. The specifications relating to this service used by the Data Controller are available on the MailerLite website through the following links:

The data for direct marketing purposes will be stored for 24 months, without prejudice to the right of cancellation, limitation, modification or opposition that the interested party may exercise at any time through the dedicated channels, or by sending a request to the e-mail address [email protected] , or by mail at the headquarters of ElectriEase, in via Piedicavallo 51 – 3/A. 00166 Rome.
You can consult the Privacy Policy at any time, in the appropriate section of the App.
Article 17 – Interactivity of the App and its prohibited use
The App allows the user to post photos or comments. The Client assumes all responsibility for the use of photographic material and additional notes. EE has the right to delete any content that it believes violates applicable laws and to report the abuse to the appropriate authorities.
EE may use photos and/or comments from users that it believes may be of interest to it for its own commercial purposes.
It is expressly forbidden for the user to use the App for any purpose that is prohibited by current legislation and EE has the right to interrupt the service in the event of violation of the aforementioned prohibitions or behavior not in line with the company "policy".
Article 18 – Applicable law
This agreement is governed by the laws of the State of Italy. In the event that some of the provisions contained in this agreement are deemed invalid, null and/or void in any case not applicable by virtue of the provisions of the law in force, the remaining provisions shall in any case be considered fully valid and effective. In the event of disputes, the Customer's Court will have jurisdiction. If the Customer has residence and domicile located outside the territory of the State, the Court of Rome will have jurisdiction.
Article 19 – Unfair terms
The customer expressly declares that he/she accepts the content of the following articles: 3 (Duration and withdrawal), 4 (Economic conditions), 6 (Invoicing and payments for charging via Public Charging Stations), 7 (Payments), 8 (BeaglePlug Wallet and RFID Card), 9 (Guarantees of credit outcome),10 (Home charging station),11 (Coupons and Vouchers), 12 (Disclaimer), 13 (Prohibition of Resale or Commercial Use of the Services), 14 (Intellectual Property Rights of EE and Third Parties), 15 (Modifications and Assignment), 18 (Governing Law).
